Terms of Service
1. Acceptance of these terms
These Terms of Service govern access to and use of Batesly, a practice management service for law firms. By creating an account, or by using Batesly on behalf of a firm, you agree to these terms on your own behalf and on behalf of that firm.
If you do not agree, do not create an account or use the service. We may update these terms; when we make a material change we will notify firm administrators before it takes effect, and continued use after that date means you accept the updated terms.
2. The service
Batesly provides tools to manage matters, contacts, tasks and deadlines, calendars, documents, time and expenses, invoicing, trust accounting records, client payments and reports. Some features rely on third-party services described in our Privacy Policy.
Batesly is software, not a law firm. It does not provide legal, accounting or tax advice, and it does not replace your professional judgment or your obligations under the rules of professional conduct that apply to you.
3. Accounts
Each firm has one account, managed by one or more administrators who invite and remove members and control their roles. You must give accurate information when you sign up and keep it current.
You are responsible for keeping your sign-in credentials confidential and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorised access.
4. Client data and confidentiality
Your firm owns the data it puts into Batesly, including client and matter information ("Client Data"). We process Client Data only to provide, secure and support the service, and as described in our Privacy Policy.
We treat Client Data as confidential. Access by Batesly personnel is limited to what is needed to operate and support the service, and every change to firm data is recorded in an append-only audit log. Your firm remains responsible for its ethical obligations. Batesly lets your firm configure ethical walls (matter access exclusions) but does not decide them for you.
5. Fees and payment
Batesly is a paid subscription with no free trial. Subscription fees are billed in advance, monthly or annually, through our payment processor Stripe, and are non-refundable except where the law requires otherwise. Prices may change at renewal with advance notice.
Client payments that your firm collects through Batesly are processed by Confido. Batesly never holds those funds, and your firm remains responsible for how it records and handles trust money under the rules that apply to it.
6. Termination
You may cancel at any time; access continues until the end of the paid period. We may suspend or end an account that breaches these terms, fails to pay, or puts the service or other customers at risk, and will give notice where we reasonably can.
When an account closes, access to it ends and your firm's records are retained as described in our Privacy Policy. You can request export or deletion of retained data from [email protected].
7. Limitation of liability
The service is provided "as is". To the fullest extent the law allows, Batesly is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data.
Our total liability for any claim relating to the service is limited to the fees your firm paid for the service in the twelve months before the claim arose.
